Loud whine at 2500rpms

So my dad drives a 06 Mazda 6 wagon manual transmission and at 2500 rpms in any gear the transmission whines really loud. Loud enough so to drond out the radio and be very annoying but then goes away when the engine speed reaches 3000rpms. The car has 18*** miles on it and is still under warranty and has been at Mazda Polar Chevy for 6 weeks no joke and they can't figure the problem out. So they called my dad yesterday and say basically they cooouuullddd put a next transmission it in but that won't fix the problem basically telling my dad to live with it but they will be as nice to extend the power train warranty to 75000 miles. So my dad tells them to put a new transmission in it because the car is under warranty and the sound is annoying. And pretty much they tell my dad he is being too picky and they won't do it. I am wondering from you my fellow Mazda lovers is there any legal stance we can take to make them put a new tranny in? Can anybody give us some advice since Mazda is being a bitch?

Thanks for all your guys help.

That's funny I see this post... My car started doing this exactly thing not too long ago..

Is it the transmission? worn belt?

I'm having my mechanic look at it tomorrow as he has to tap in a new bolt to one of my stripped tranny mount-to-tranny hole (currently running without a bolt)..
