need advice if you live in new york..

Hey Guys ,, i need some suggestions/advice if you live in new york, so i recently got pulled over for speeding...i had 7 points already... so last week when i got pulled the highway patrol officer gave me a ticket .. in the ticket it says " A guilty plea or conviction of a speeding violation of 21 mph or more over the speed limit will add at least 6 points to your lisence and subject you to a driver resposibility asessment" so i was doing 80 mph on a 50 *supposively* i think i was going faster but anyways.. i really dont know what to do.. and i have 13 days to respond to the ticket.... if i plead guilty ill get 6 points and i plead not guilty ill have to go to court and testify agaisnt the cop if he shows up, judge ect.. so i would really appreciate your advice. o yea i drive to work everyday so i kind of need my license.. thanks..

I'm not trying to start a fight, but my best advise is, stop speeding. DUH! Its not worth it in anyway. It doesn't save you time stop signs and lights see to that, it can cost you money via fines or your license, and it can kill you or someone else. Its just not worth it.

well yeah i know it was really stupid of me .. but this happened in the highway i was going to work i was running a bit late and it was 4am the highway was practically empty... but in the city i drive really carefully. but yeah i dont know what to do...

Dude, you are fucked and let me explain why.

1) The driver responsibility assessment is fined against you when you reach 6 points on your record. As you already have 7 points on your record, you should have received a notice from the DMV ordering you to pay 300 dollars (which is the amount of the assessment). I believe that assessment goes up for additional points you accrue on your record; however, I did not look as the last time I had to fight a ticket in NY state for doing 80 in a 55, I was only concerned about the 300 dollar assessment as my NY record was clean at the time.

2) Since you live in NY and I know the point system there pretty well, at 12 points you will have your license automatically suspended. Since you are at 7 points, another 6 will bring you up to 13 and you can kiss your license goodbye.

My advice is you absolutely have to go to court either to take a plea bargain (which they have offered me every time I've gone to court) or bring a lawyer with you as you risk losing your license at this point. You are already boned on the assessment so expect to be forking over 300 dollars sometime in the near future.

Almost identical to PA law. Only we get a special points test that cost 150$ at 6points. But your advice is spot on.

yea im aware of that, i was thinking of getting a lawyer and trying to lower the points im getting ,i payed for my first 7 points accumulated i think last year it was around $300 something..o yeah and i got those point over a years and a half ago if that could help.... and i thought it was 14 points that would get my lisence suspended..??? i recently did the classes to bring the points down.. damn but FML serious fuckkk im really frustrated smh..

If you took defensive driving your record should have been reduced by 4 points which puts you in the safe zone if you were to plead guilty to the ticket. Your best bet is to plead not guilty and show up and hope they offer you a plea bargain, that is your cheapest solution. Because you have such a colorful record they may not do that though. Since you will most likely have to pay the assessment again if you plead guilty, your ticket becomes incredibly expensive; around 500-600 dollars at least.

Definitely go to court man.

FYI most lawyers charge about 500$ to represnt you in traffic court.
