Re: Who's at fault for this accident?

I'm confused. If the car was in the left turn lane, why would the other person have to signal to go around them. Was the other driver also in the left turn lane?

agreed, however the story sounds odd.

Is there an actual marked left turn lane? How many "straight" lanes are there?  Why would the person going straight need to signal at all?

edit: daniel beat me to it

Huge unmarked lane enough to fit two motor vehicles, and the vehicle that signaled to go to the right lane was about 2-3 car lengths behind.

If its unmarked, its one lane. I would say the car that passed on the right did an improper pass and is at fault.

Not true,
http://www.mass.gov/legis/laws/mgl/89-2.htm

"The driver of a vehicle may, if the roadway is free from obstruction and of sufficient width for two or more lines of moving vehicles, overtake and pass upon the right of another vehicle when the vehicle overtaken is (a) making or about to make a left turn, (b) upon a one-way street, or (c) upon any roadway on which traffic is restricted to one direction of movement."

Be that as it may, one can assume by the basis of this thread that the driver who made the pass on the right was found at fault (by the police) so in this situation the officer must have deemed there was insufficient room to make the pass finding them at fault.

Re: Who's at fault for this accident?

your explanation is very retarded and just for that, you should be at fault.

OK, from the sounds of it, the person tried to get to the left turn lane to turn left (with signals on), they do not fully make it to the left turn lane and decide to go back to their original lane, while a car on that particular lane prematurely tries to push ahead and collide?

Anyways, it sounds like the accident could have been prevented, so both parties are at fault.
