What now... Speeding ticket 15 above

Ok i was going at 2 at night (FUCK me, main reason prolly) and drove no more than 45 in 35, yet i was keeping with traffic. Cars all around me, I see the cop on the opposite direction, still slowed down to 40, than 35. I see him turning around, and going behind me. I tell my friend in the passenger seat "buckle up", I always tell my passengers to do that, yet didnt do it this time. I see lights, cop comes up and ask "you know the reason I stopped you?" I went "No". He went " you were doing about 50 in 35 mph zone" (which is complete bullshit, no more than 45 for SURE). Not to mention cars were around me, so i dont see how he's sure its even me. Now i never had a ticket, and dont want fricken points on my record. How can i fight this, I know for sure i wasnt going 50, and there were cars around me. How else can i defend myself in the court, for which i'm going for sure, since i cant afford FCKIN points. Money is not a problem, and please dont tell me "you should have went slower", maybe but i kept with traffic simply. Stupid suburban cops...

Sorry for gramatical structure, but i'm pissed as hell.

The surest way to avoid points is to drive the speed limit. Doesn't matter what 'traffic' is doing... if the officer wants to write you a ticket, he's got you by the short hairs. If you decide to go to court, you probably need to calm down and dump the attitude beforehand.

Re: What now... Speeding ticket 15 above

from the way you describe what happened it sounds like he was estimating your speed. If you want to fight it, go ahead it's your right to do so, but be warned. Don't think the cop won't up in court (they usually get paid overtime for court) The judge will automatically side with the cop, since he has experience judging vehicle speeds, and he is a cop. The judge will listen to you, but you already admitted you were speeding. The best, although unlikely, result you can hope for is a dismissal. More likely is either: no points and just the fine, or points, and half the fine. Something along those lines. My advice, take your lumps, slow down, and go to traffic school to get the points off.

Telling the judge you were keeping up with traffic will be admitting your guilty.

i wouldn't say keeping with traffic, I'd say there were cars around me, which could produce false reading of the radar. But honestly, I have no idea, what i should do, admit and ask for no points, or fight? As I said, I've never had a ticket, so i don't know how it works.

Get a good attorney, they will help get you out of this. They can ask the DA to request prayer for Judgement, being your first ticket, get this thrown out and no points, just pay court cost. Since you say money is no object. Let the attorney represent you, show up in court if needed and watch the Attorney work their magic.

Did he get you on radar or did he estimate your speed? Did the cop write a specific speed or something like 45+ mph? If he has you on radar you are gonna have a hard time fighting it in court. The burden of proof is going to be mainly on you to prove the cop f'ed up. If he has you on radar, it's easiest to just pay the fine and go to traffic school. It will take the points off your license.

If he estimated then it will be on slightly less of a PITA. Again the judge is going to take what a cop says much more into his decision , then what you say. What are you going to tell the judge, that you were speeding, but with the flow of traffic, and that you were singled out? the judge is going to probably mad you wasted his time.

He said about 50, so I guess he was guessig, yet he wrote 50 on the ticket it's the same rubric speeding 1-20+ over. Honesltly, now I just don't want it to be on my record, since from what you're writing, judge is gonna be on his side, and since it's suburbs where it happened, it's very believable.

Like I said ask around, find a good attorney. You are worried too much. Attorney will get you out of this this clean without points. Firsr timers getting minor speeding tickets usally get throw out with just court cost.
