40$ for a 9hr day of work

This small company I work for took my gf off of being hourly (not on payroll hourly) then told her she was gonna be a subcontractor. (they dont wanna pay taxes) Today she made $40 for a 9hr job. How the fuck is that legal? After gas and supplies she bascially made $30 take home or $3.33hr. There has to be some kind of catch, loop hole something. Shes called the Il labor laws a few times and they have told her there needs to be a signed contract of payment agreement, which this job has none. They bascially gave her a list of WHAT she is getting paid and thats that. Then today they sent a hourly person there to do half her job so she would only get paid for half of that job instead of the full which she was entitled to. Is there really anything to be done besides her telling them to fuck off and leave?

According to a quick Google search, the min. wage for Il as of July 1, 2009 is $8.00/hour.

First, haven't seen you here in a while, good to see you back.

Second, state employment commissions are a joke. Have her contact the US Dept of Labor. They don't f*ck around.

Further, have her file the IRS form with her taxes disputing her status as a 1099 contractor. The IRS loves getting employers on misclassifying their "employees".

Not to be a dick but is she really lazy? Most places wont pay a person more to do a job they're already paying someone else jack crap for doing? Sounds to me like they may feel she wasn't pulling her weight.

Regardless if you didn't see it or not online, there must be information posted at your employer where all employee have access to. Usually the information is posted in a break room, stock room, or HR area. It needs to clearly show what your state's min. wage is. The city/county you work in may be higher, but you should be paid at least what the state says is min. wage.

Does that apply for people being labeled as subcontractors?

Na she aint lazy, she busts her ass, trained by me. We do housing foreclosures, and its 40$ to clean a house (this company pays). Well they stuck her in this big ass house ALONE so she spend 9 hrs cleaning it up for the bank. Its more or so they are picking on her because A. shes a girl
B. she stands up for herself and tells the "owners" its not right

Where as my brother and my sisters husband do the same thing, but are always paired up with each other and take in 100-150$ a day all week long.

You will need to check with your State's labor board. Seeing as I don't reside in IL, I couldn't answer that for you.
