Question about Arizona Speed cameras...

So during my move from California to Ohio I got a ticket on highway 40 in Arizona by one of the speed cameras that is mounted on top of the suv cop cars. I was going 78 in a 65. I was unaware of the fact that the speed limit had dropped back down to 65 from 75.

Also on the ticket, there is no descriptive info of the suspected driver, or even the registered owner.
It just has all the vehicle info. There is no height, weight, age, or any other info that would be found on a drivers license.

Now i read somewhere online, I forget where, that said you can almost just ignore the whole notice. At which point a complaint is filed in court, and they are given 180 days to hand deliver it to you. And if it isn't done in the time frame, then it's dismissed. The registered address isn't my current address, because i haven't updated it to my Ohio one yet. So the notice i got in the mail was forwarded from California. So i could just say that I never even got it.

A few other questions. Does arizona offer any ways to contest the violation by mail like california does since I don't know when i will be in Arizona again?

any questions and comments and advice on fighting the ticket would be awesome.

depending on ur situation, it sounds like its worth the risk

Re: Question about Arizona Speed cameras...

also, i've been looking into the laws some more, and the arizona vehicle code says there must be 2 yellow signs at least 300 feet before the camera warning of a speed zone. I saw no such signs...

78 in a 65? are they serious? please find every loophole known to man to fight that, it's ridiculous they gave you a ticket for 78 in a 65, thats 13mph over the speedlimit.

Don't buy from Dabears2k.com - They sell counterfeit parts.

Re: Question about Arizona Speed cameras...

Here in Mass, Staties usually ticket for anything over 75mph, but all of our highways, with only a handfull of exceptions, are 65mph. Seriously, I hate cops here. I was going skiing in VT this past December, and I got pulled over for 85 in a 65, but I was passing a CLEARLY intoxicated driver who was waivering and swerving their way from 45mp to 75mph and decided it was safer to pass them LEGALLY as quickly as possible. Took the ticket to court, lost, and had to pay an extra $50 in court fees on top of my $150 ticket. The judge wasn't having my argument one bit. And, to boot, the Statey that pulled me over was present at my court date. Such garbage.

I have yet to be caught by a speed camera, but I wish you the best of luck. They can't really prove anything unless they have a driver description, IMO. Contest the ticket, see what happens, and worst-case scenario, you pay the fine. I think it would be worth a try.

Re: Question about Arizona Speed cameras...

The cameras here are set for 11 over the speed limit. I'm surprised they even mailed the ticket to California, let alone having it follow you to Ohio. Good to know for the future. The local news has been talking about such a huge number aren't even mailed out.

Arizona was a state where simply receiving the ticket in the mail doesn't count as being served but I've heard recently that the standard has changed. So now it would effectively make regular mail count as service of the ticket. I'm not sure if they can make a move to suspend your license for non-payment since you're registered from out of state, maybe consult an attorney familiar with Arizona service laws?

As for the signage, good luck proving it, I've heard people locally that have no luck pleading that when they appeared. The mobile cameras mounted on the Ford Escapes can be tricky, I've seen them arranged oddly and especially seeing them on the left side of the road when they place the signs on the right.

Just ignore it. I do the same thing for the toll road tickets I get when I'm in Texas.

The speed cameras here will clock you if you are going 11 mph over the posted limit.

And to the OP:

I have heard of claiming to have never recieved the ticket in the mail, and then it being dismissed. I'm not entirely sure if this is true though. But I have also heard that it needs to be hand delivered to you in order for you to be fined, otherwise, yeah, you can say you never got it. And in your situation, having the address change or whatever, it seems to make sense. Also, about the yellow signs. I'm pretty sure it IS law to have them. One a 1/2 mile before saying Photo Enforcement Zone, and then another at 300 feet. That is a good thing to mention if you do have to end up fighting it.

Good luck with everything. AZ sucks with these cameras...lol

Re: Question about Arizona Speed cameras...

Yeah MD has been pushing for photo enforcement. There is a huge push against it from basically everyone EXCEPT the state legislature. I mean HUGE push against it including from the counties (except Montgomery, they are the sole county pushing for it) and from the citizenry (including a huge number of petitions against).

Basically everyone including the state legislature is looking at it as a revenue source, not a safety/law enforcement effort. I believe the MD plan is for fixed photo enforcement with the cut off set at 12mph over and only on highways I believe.

Driver information is immeasureable when using speed cameras.

Why don't you call the DMV and have your questions answered...or look for a reputable website, not just "some information" from the internet. Most states will have their state code or laws/regulations posted online. Good thing it didn't come certified mail.

That seems like a good amount to me, something that an officer would ticket for if caught.
