"MIAMI (AFP) - A Florida judge has deemed unconstitutional a law banning baggy pants that show off the wearer's underwear, local media reported Tuesday.

A 17-year-old spent a night in jail last week after police arrested him for wearing low pants in Riviera Beach, southeast Florida.

The law banning so-called "saggy pants" was approved by city voters in March after supporters of the bill collected nearly 5,000 signatures to put the measure on the ballot.

The teen would have received a 150 dollars fine or community service, but he spent the night in jail due to a history of marijuana use, the Palm Beach Post newspaper said.

"Somebody help me," said Palm Beach Circuit Judge Paul Moyle, before giving his decision.

"We're not talking about exposure of buttocks. No! We're talking about someone who has on pants whose underwear are apparently visible to a police officer who then makes an arrest and the basis is he's then held overnight, no bond."

"Your honor, we now have the fashion police," added public defender Carol Bickerstaff, who asked the law be declared "unconstitutional."

The judge agreed with Bickerstaff immediately, reported the Post.

Laws that ban low-slung pants are on the books in several US cities, including Delcambre, Louisiana, where offenders can be fined up to 500 dollars or jailed for up to six months.

Dallas, Texas and Atlanta, Georgia are among the larger US cities considering similar measures."

i think this is a stupid law
i mean i dont wear baggy pants anymore
but wheres our freedom going?

I think its a dumb law. Sure when you dress like that you look like a complete asshat, but that's your choice.

I can't think of a single rational arguement FOR the law. Sure, baggy pants can hide weapons, maybe, but you can wear baggy pants at waist level and its perfectly fine.

I don't think you should be able to pass a law that says "you can't look like a total fucktard" but I guess people are doing it.

In my ideal world I would rule everything and pass decrees at a whim. Since it isn't and I can't be the one making those decrees I think it it total bunk for a law like that. I am glad the judge agreed. I think people look like idiots wearing pants like that, but so long as they aren't actually naked I see no issue.

Now if an establishment wants to enforce a 'no baggy pants that show your underwear' rule, I see no issue. Okay I think it would be idiotic, but I feel it is up to them. Now controlling who can or can't come in to their establishment without a darned good reason, maybe not, but a dress code, certainly.

The community of Pine Lawn has had enough of kids walking around in baggy pants, their underwear showing - or worse. The city has passed an ordinance establishing a $100 fine for anybody wearing pants below the waist so that underwear - or skin - is exposed.

Parents also can get hit with a fine of $500 if they let their kids go out with baggy pants - or even those low-riding tight jeans that expose a little too much ... or much too much.

I don't wear baggy pants that show my underwear. I simply go out in public without pants. Oddly enough, I get a lot of "thumbs up" from the natives.

Eh, IIRC it started because of a certain popular rap artist had a hit song with a lyric about his pants sagging cause they were "stuffed deep with the benjamens". And then someone killed him, so its a tribute him / making people think you roll deep with cash. It's kind of similar to donks and rolling on 20's / double deuces / twenty fo's.

So in short, blame the rap music videos.

I live in Louisiana and never heard of a place called Delcambre

'Eh anytime I see that I tend to think more that the person should be wearing a tux, cuz then at least he looks like a penguin to go with the way they have to walk.
