Ticket woes. Me VS. Stupid Cop....who will prevail?

Disclaimer, I'm not the type of person to whine, bitch, moan or complain about getting a ticket. Typically when I get a ticket, I know that I deserved it, but tonight just simply wasn't the case. I also, don't really give a shit about getting a ticket, as I can get them fixed for damn near nothing, and not have to worry about it. But this one just rubs me the wrong way.

Driving back from my garage tonight and an hour ago (2:25am) I was pulled over for supposedly going 74mph in a 55mph zone in the lovely jurisdiction of Pine Lawn, MO. Pine Lawn ain't exactly a place you want to be in at this time of night if you are white. But whatever, thats besides the point.

Anyways, as soon as I got on the interstate (I-70), I set my cruise control at 65mph, even though the speedlimit is 55mph, if you go any slower than 65mph you will be impeding the flow of traffic. Now, I'm following another car in the middle lane and keeping a perfect 3 second following distance with my cruise set at 65mph, as a matter of fact, theres another car in the right hand lane further ahead that I'm neither closing distance on, in fact hes putting some distance between us.

And then comes Officer Keep Whitey Down, at first I just thought it was another car, comes flying up on my passenger side, pulls about a half car ahead, and then brakes hard, pulls in behind me and turns on his lights. At this point, I figure hes just going to harass me about my tint. I pull over to the right, pull half off the shoulder into the grass to give him plenty of room, and turn my hazards on. Roll down both front windows, put both hands on top of the wheel, and wait.

Officer comes up and says "I got you clocked at 74 in a 55." Not wanting to have him flip out, I figured I'd just say "Oh, sorry about that sir, I didn't even know." Knowing full damn well hes full of shit. As not only was my cruise control was set at 65mph, but my radar detector never even made a peep, and that thing has NEVER let me down before. Also, he was never directly behind me, nor was he ever going the same speed that I was when he was next to my passenger side.

Anyways, he writes me the citation, and tells me to drive safe. Pissed that he was lying about the ticket, I get fairly ignorant while leaving and leave a fair amount of rubber when I get into 2nd gear.

And now, that I'm home looking at the ticket, I see a few things on it that are in my favor.

First off - The spots where the ticket has "vehicle going XXX mph" in a "posted speed limit XXX mph zone" were both left blank.
Secondly - The "Detection Method" spot where "Stationary, Radar, Moving Radar, Watch (Air), Watch (Ground), Pace, Other" are listed, is once again, left blank.
Third - He improperly called my car a "2 door" in the "Vehicle Style" spot.

The only thing the ticket has on it is "Did then and there commit the following offense. The facts supporting this belief are as follows: SPEEDING" and then "In Violation of: 335.041" (I think thats what it says, his handwriting is complete shit.)

So the ticket has NO INDICATION I was speeding any amount over a certain limit on it. Normally, I would just hand this to my lawyer and "Say take care of it.", and never have to step into court. But this one is a little bit different. I'm thinking about not even bothering with the lawyer and going to the court date to make a complete ass out of the cop, what do you think?

That won't hold up in court.

Just go to court and it will get thrown out.

Re: Ticket woes. Me VS. Stupid Cop....who will prevail?

Fight it for sure. That is pretty much a generic 5mph over ticket. $85 here.

I completely agree that it wouldnt hold up in court.. this IS one reason I did not get a red car, regardless of how hot it is. If you were in a silver car this would ahve never happened..

I wanted a nice dark gray. I have seen a couple 3 red sedans, they look nice too. But yeah amd, im sure that'll get thrown out, as its not filled properly. Remember, it's your right to ask for proof with a radar gun.
