Insruance companies fighting fair insurance law

http://www.cnn.com/2007/US/law/09/28...ote/index.html

Interesting article to read. The jist is that in Washington state if your insurance company denies your claim and they lose in court (IE you had a legitimate claim) then you get triple your damages and legal fees. Sounds pretty fair to me. Insurance companies of course don't like that one bit.

I come down on the side that if insurance companies were truely playing fair at worst they might see a few cases here and there where they truely believe fraud is going on and it isn't and they got stuck with a big bill. Of course they'll lose millions because it means there is a big financial penalty to them for routinely denying real claims.

PS I also some down on the side of making this a nationwide law. Of course I could be okay with just double penalties, but whatever.

yup, no fault means that, if you get in a wreck and its ur fault you still pay for ur car and they pay for theirs. but if your state is not a no fault state then the person at fault pays for both cars. i think..?

No fault to the best of my knowledge means that you are partly responsible for any accident you're involved in, even being rear ended...

Wish mine was a no fault state, I got screwed on my accident. Wasn't my fault, even a witness who noticed said it was not my fault.

Re: Insruance companies fighting fair insurance law

Guy pulled into an intersection were I had the green. He cut across 3 lanes into my lane which I was in forced into slamming on my brakes and I hit his driver side quarter panel and metal bumper. No damage to him, $7,000 for me. Officer said I was doing 65mph, I was not. I had a cop from another district do the accident investigation and said I was doing under the speed limit, and that because of where I hit him, they have to blame me. He said if the aftermarket metal bumper would have not been their, and I would have hit just his quarter panel they could blame him.

Ain't that some fu*** up stuff. Because I hit the very left corner of his bumper.
