Need some help. Insurance question RE Stolen car.

My buddy's car got stolen last month at gun point.

They took his keys, everything.

When he asked the insurance company if they would replace the key/tumbler they said "it wasn't part of the car" and advised him "to contact his home owners insurance." He told them, they know where he lives and they may still have his key. They told him, "well if your car keeps getting stolen your rates will go up."

Home owners is telling him he'll have to pay ANOTHER deductible (he already paid for the auto part) and his rates will go up even though this is the first claim.

I'm like WTF?!? His S40 will not start without the coded key. To recode the one key, order a 2nd and replace both tumblers and both door keys it is ~600$. His HO ins deductible is $500. He already paid $500 deductible on his car insurance for his stolen car... It is still in the shop >1 month later.

He is through State Farm. If anyone works there or has a good contact that can verify that the keys aren't covered please let me know.

It isn't like he's asking for new locks on his house or his wife's car (which they have a key to).

Re: Need some help. Insurance question RE Stolen car.

Well I was referred to the State Department of Insurance for the state in question.

Good advice and I found a decent PDF for any of you wondering what to do in this situation.

"Like a good neighbor" my ass. If my neighbor treated me the way state farm treats people, I'd kick him in the nuts.

Thank god for USAA

I've been on the receiving end of USAA... not too happy with them either. "Yeah, the whole front end of your car is gone. We're going to pay you what it is worth now, not what it was worth before our driver hit you."

wow. I've had nothing but good dealings with them. Although to be fair, I'm a customer so maybe they treat me better than people that I hit.

Re: Need some help. Insurance question RE Stolen car.

Ahahahaha!

Everyone. Make sure you review your contract on at least a yearly basis.

It is a little early for celebration but.... he found his contract:

Quote:
Section IV - Physical Damage Coverages
Loss - means, when used in this section, each direct and accidental loss of or damage to:
1. your car;
[red] 2. its equipment which is common to the use of your car as a vehicle[/red]
What does that mean to you? A coded key, that will only work on one car. And the car cannot function without it. IE, common to the use of your vehicle.

Quote:
apparently any clothes or luggage would have been covered, unlike what we were told
And today he was offered free legal representation from his alma mater (contingent upon review of his contract)... He has a few wins under his belt against these guys. [] And the school he graduated from is no second hand wanna be law school. []

Can't say anymore regarding that don't want to jeopardize anything further than I have.

It sounds like he is in this one for the long haul.

That sucks.

Only good thing I could see coming out of this is:

Let them break into his house, and once the step foot into his house. Beat his ass.
