hit by uninsured motorist

hi there, my 3 got hit by an uninsured motorist and he's at fault. i called 911 and got the accident report. Problem is, when the cop was getting information from the guy, he does have valid insurance. But when I call up his insurance company, I was told he no longer insured by them. So I suspect the guy is driving without insurance. I called him several times, but he refused to speak to me. What other options do I have to make him pay for my damage. Please advice. Thank you in advance.

Have you reported it to your insurance company? I'd talk to your rep. inform them of the details and give them the police report. If the other person is insured and is at fault then your insurance co. will seek reimbursement from his insurance co. If he's not insured then your insurance co. will seek reimbursement from him. Remember they have lawyers and will go after the money that's owed to them/you.

If you do go that way then make sure that they're going to be seeking reimbursement for your deductible as well.

thanks for the reply. Actually I've done everything I can to make that guy pay for my damage. My insurance company got all information needed. Now I'm waiting for a quote to get my car fix and fax it to that guy's insurance company so they can send me a letter of denial. in fact, my insurance just called while i'm typing this message. she told me what exactly you've said. lol. thanks for the advice. I'll appreciate it.

What icspots said is correct.

If your state, like mine, requires insurance I would contact the police department that issued the citation. The driver can loose their license for 1+ years in Ohio for driving uninsured. Then, when they get caught driving on a suspended license and no insurance they'll go to jail.

well, i called the cops yesterday and and was told everything is in the report and advised me to speak to my insurance company.. i dont have a chance to explain to him that the guy is using fake or no insurance. how sad.. and that's NYPD. Now i know why my insurance advised me not to tell the cops about it. I really feel like I'm unprotected. I pay tax and stuff, the people just created the mess and got away with it. I have to pull 500 out of my pocket to fix something which isnt my fault. Some people advised me to sue him, but I really dont have the time to deal with that. If he could not afford insurance, I dont think he could afford reimbursement for my damage even if the court favors me. Just feeling very bad to have involved in a case like that.

My advice is to let your insurance handle it. I just dealt with a hit and run and it sucked giving up $500 for the deductable but that is what insurance is for.

The worst situation for the other driver is to have a pissed off insurnace agent calling for money and then dealing with all of their high priced lawyers. I hate paying insurance but in these circumstances they come in handy as they are ruthless.

the insurance company won't want to loose money. They will either get it from him or them.

So make your claim, get your car fixed, get reimbursed for any other damages (to your body if there are any) and be on your way.
You paid for ur insurance, so you get to use it.

In my province, since it is 100% non-fault, (according to the police report) your insurance rate shouldnt go up. But its different everywhere.
