Is This Legal??

I've spent an hour doing web searches but haven't found anything about my specific issue, so if there are any legal-eagles on the board that know something about this, please speak up!

My employer is moving around 75 people into my building (from a building they're closing) and facilities management has already noted that there is an obvious parking dilemma involved....there aren't enough spaces at our building to accomodate that many people. What management is saying now is that if we arrive and there is nowhere to park, we must drive to the Park & Ride station (DART) about 3 miles away and ride the bus to work.

Is it legal to 1) not provide adequate parking and 2) require employees to ride public transporation because they've failed to provide adequate parking ??

Let's hear it! I'd like to know if we have a leg to stand on.

I cant say it would be "illegal" but Id say if they start marking you late because you have to take more time to drive 3 miles away from work then wait for public transportaion to get back that 3 miles, that you could have some legal action but its likely they are going to just say get there earlier

Um, welcome to living anywhere that isn't suburban? I work at city hall and we don't even have nearly enough parking.

You wouldn't have any action for any reason - if you're late to work, you should have left earlier

it obviously depends on state and city laws, but generally your employer is not required to provide you with parking. If they do provide parking, then they must provide a certain amount of handicapped parking, but beyond that I don't think there is a requirement that they give you a parking spot.

Don't know where you work, but if you live in Dallas then take a drive downtown and think of all the people that work in those office buildings and then ask yourself where they all park at their jobsite. The answer is: they don't, because there isn't enough parking. They either take public transportation or pay to park somewhere (often, in a garage underneath their building that is operated by another company).

The only position you've got is that your employer is an asshole. Other than that, you don't have much room for argument.

Murph, I've witnessed you present a lot of pertinent facts on this board since I joined and I can easily say you've never hit the nail so squarely on the head. ;-)

even then, they're just a bunch of jerks. You don't really have any real claim. Getting yourself to and from work on time is your own responsibility, even when conditions beyond your control are changed. The general response to such a claim is "find another job." Especially if you work in an at-will employment state, but even in more regulated areas I don't think you have a claim.

The only way I could see you having any sort of legal claim would be if your employer required you to use your own vehicle for your job (deliveries, on-site work, etc) and then fired you because you couldn't park your car at work. But even then, I would think you would have a weak claim.

...and the 'finding another job' is in the works as well.....they've finally found a way to make Telecom suck worse.

if it took losing your parking to make you want to get out of telecom, then your threshold for pain is far above mine.

To be honest, I THINK I get here early enough (7:15) to avoid that, even if my 'choice' parking space isn't available, I suspect there will be somewhere to put the truck...but leaving for lunch / errands is now out of the question. The parking is just the last .0000001 oz. straw that may break this camel's back.
