Told my step-dad about it and I told him how I wish I had grabbed the Mag-lite in my back seat to use on that kid. He said that they could have charged me with assault with a deadly weapon. I think that it would have been self defence.
technically speaking, if someone comes into your car like that you're well within your rights to use a weapon to defend yourself. (specifics vary by state of course)
however, in many jurisdictions you give up a claim of self defense when you engage in the sort of actions you describe before the actual assault takes place. At that point you're just as guilty as the guy who throws the first punch or enters your vehicle. It's not self defense if you talk shit before the fight or otherwise engage them prior to the assault. That's not legal advice, just a general comment on how many of the self defense laws are written.
So, in other words, if you want to be able to kick the shit out of them and not get charged, then keep silent and let them come to you. Chances are, it wouldn't have gone beyond the first dirty looks if your friend hadn't made his incredibly funny yet tension-escalating comment.
Sounds like an exciting night. I don't understand this, however:
I am pissed. I am ready to take on all 5 of them by myself. I don't care because they just totally disrespected my car. I'm wet, my dash is wet, my windshield is wet (on the inside), seats, headliner, it splashed everywhere.
"disrespected" your car?
