run in with PoPo

got my first ticket in my 3. it was a crazy one -- failing to yield to an emergency vehicle --

basicly I was in the lane when the FIVE-O was trying to pull over another car. My car was blocking his lane. Since my adjacent lane was occupied with cars and I didn't bother speeding up, I was trapped in my lane with him in my rear. After much indecisiveness, I pulled over to the shoulder (after he pointed at the shoulder) and the FIVE-O flew pass me on his bike. Thought everything was ok and went back to the lane and continued my driving. When I passed the FIVE-O again (he got the guy he was after on the shoulder), he started waiving frantically. At the moment, I had no idea what he was doing. Turned out later he wanted me to pull over next to him.

so the crazy cop gets back on his bike and comes after me. A mile later, he caught up with me and pulled me over. throws a fit about how i didn't yield to him and was disrespectful to him.

so the way i see it, i didn't really failed to yield him. I may be guilty of taking too long to pull over but NEVER FAILED to. Do I have an argument in that? I plan on taking this to the court because I feel this citation is purely subjective.

what do you folks think?

describe the shoulder. If it was a common highway shoulder with room for your car, I would ask why you didn't simply pull over there to begin with.

I would definitely go to court. When you're sitting in traffic and everyone is going every which way to get out of the way of an emergency vehicle, its easy to become confused and not know what to do

Is your ticket for failing to pull out of the way the first time, or not pulling over when he was waving at you when you passed him later?

shoulder as in the common highway area with room for the car. I think at the time i panicked. first it was early in the morning at 7 -- half asleep (i'm not a morning person). then i thought about speeding up to get into the adjacent lane. -- bad idea. Then i remember I have seen cars in my situation where they just sit in the lane. The popo simply bypassed them. At the time, I was fairly certain he wasn't after me. so i took the latter route and sat in the lane until he pointed me to move to the shoulder, which i did. All that happened fairly quickly within less than 30 secs.

the guy never explained what the ticket was for. Think he just wanted to give me something for the hell of it. But the focus of his discontent was on the first pass when i sat in the lane. so i'm guessing it's for the first time.

be lucky you weren't thrown in jail. A lady friend of mine was put in jail overnight for not switching lanes, she did slow down; however, the cop pulled her over and he said she almost killed him... wow

This new law in texas (maybe elsewhere) allows officers to write these bogus tickets to pepole if they think they aren't moving quick enough for their speed. My uncle is a judge... take it to court, argue your point. He says not many people have had to pay these in court.

The cop may not even show.

This law reminds me of the license plate law, if anything covers up the reflective part of your plate you can get a ticket (even if all your letters are showing) The law was aimed at stopping people with the covers that blur out photos at toll booths / traffic cams.

interesting .. first time hearing a judge stands on your side. thats why i'm going with trial by jury instead of trial by judge. probabably have better luck with the jury than the judge in this matter.

walk in with a lawyer, talk to the prosecutor, case dismissed..

Yea man ur in the clear. The cop was obviously pissed off and being a cock smoke. You are much better off paying a lawyer a couple hundred bucks than losing the points on your license and having your insurance go up. Think long term.

If you do go to court, the cop probably won't even show up. Case dismissed, and you are fine. Go back to work so you don't lose out on your day of pay!

I saw the dash-cam of the police officer responding to my accident. Lady did kinda what you did... but pulled back onto the highway when she saw he wasn't trying to pull her over. Almost ran him into the semi in the middle lane. :shock:

I have been in your situation. No place to go. Right lane packed. No left side to pull off on. I just sped up. 80mph in a 55... I was kinda clearing the road for the ambulance.
