accident help

No, thank god the 3 wasn't in an accident. However, my old car (1996 grand prix) that my brother now owns was in the accident...long story short, he was ticketed with reckless driving. Now with that, could he go his court date and make a deal to cut the points off, could he do that even though he caused an accident?

If it really was his fault, it's not likely that they'll reduce either the points or the fine.

A co-worker wrecked his Boxster recently. He was going up an on-ramp (under accelleration) and hit black ice; the car swapped ends and went onto the highway essentially backwards, where he almost went under a semi trailer. The nose of the car hit the tires ad this shot him back out from under the truck. He got ticketed for failure to control, which in Ohio is a 2-point violation. When he went to court, he pleaded his case and they knocked both the fine and the points, but that was because he was pretty much the only one who took any damage from the accident and the cause was really the black ice. In your friend's case, if he can somehow convince the judge that something other than his willful actions caused the accident, he may be able to get something off. But the way you describe it, it sounds like this was something he brought upon himself. (Not being accusatory, BTW - it's never fun having to go to court. Hope everything works out in the end.)

It was my brother...He's 17 and has a clean record so far. He was late to school and illegally passed someone who was turning and didn't see the people in front were stopped and he went right into the back of a maxium who hit into a mustand who hit into a civic. (yes a 4 car accident) and while they were dealing with the police and paramatics (no one ended up in the hospital) 2 rubber neckers got into an acc. lol...so in the end he basiclly caused a 6 car ax. haha...he only hit the lady doing about 25 or so...He popped her air bags but not his own and both the maxium and the mustang had to be toed because neither would start...anyway...We're just looking for him to goto court make a deal with the DA and hopfully cut the points but they'll prob increase the fine (which is ok since insurance will be much much more for longer)I'm just not sure if you can do that if you cause an ax. I know you can do that for speeding or w/e.

Well, it never hurts to ask. And yeah, the insurance is going to spank him harder than the judge will.

They very well might do something about it. I got a ticket for doing 100+ in a 45 on my motorcycle and I had to go to court for speeding and careless driving. I talked the the da and didn't even ask for anything to be removed and she just said she would drop the speeding charge. I have no idea why. All I did was explain what I did. So, if you have a choice definately talk to the da and just say what happened. Work school in there good as the reason for driving carelessly. The clean record helps too. The careless driving charge still cost me around $300 though plus whatever insurance premiums went up for the next 5 years or however long it's on my record.

I don't know about your States, but getting a careless/reckless driving charge is *nasty* in Ontario. I would pick a speeding ticket over careless anyday, unless it was a REALLY insane speeding ticket (120 in a 20 zone or something)... then I would call it a tie.
