Only in Florida

http://www.nbc5.com/travelgetaways/5...mp;dppid=65172

Quote:
MIAMI -- Florida has a new law that gives legal protection to someone who shoots somebody else as long as the shooter feels threatened or is attacked.

Florida's "stand your ground" law, which took effect Saturday, says citizens no longer are obligated to retreat from an attack if they're somewhere they have a legal right to be, such as a public street. Shooters also get immunity from prosecution so long as the person shot is not a police officer.

One gun control activist said there is no other state in the nation and no other civilized nation on Earth that has a law like this.

And one visitor to Miami said "it's a little scary" learning about the new Florida gun law.

A gun control group is handing out leaflets at Miami International Airport, making sure tourists are aware of a new law that gives greater legal protections to people who shoot or use other deadly force.

The Brady Campaign to Prevent Gun Violence tells visitors, "do not argue unnecessarily with local people." It says, "If someone appears to be angry with you, maintain to the best of your ability a positive attitude, and do not shout or make threatening gestures."

Brady Campaign spokesman Peter Hamm says Florida's new "stand your ground" law could cause the most aggressive people in society to overreact.

Gov. Jeb Bush has denounced the Brady Campaign as "pure, unadulterated politics."

But the tourism industry is taking the campaign seriously. Visit Florida said Florida is "very safe" and that the Brady Campaign is "one group's political agenda."

Supporters of the law, pushed by the National Rifle Association, say it will make Florida safer.
so if i feel "threatened" i can just kill them?

Re: Only in Florida

If one reads the law it essentially does 3 things
1) It creates the presumption that if there is an intruder in your home he is there to cause great bodily harm.
2) It removes one's "duty to retreat" if threatened with fear of imminent death or great bodily harm. *Under the old law a person resorting to self defense had to prove that there was no avenue to retreat whatsoever. *This makes no sense. *You're telling me someone comes at me with a knife on the street or carjacks me I have to turn my back on them and try to flee. *Under the new law one may "meet force with force"
3) Thirdly, it removes the chance of civil prosecution only after one is cleared criminally. *Under the old law you could be completely justified in self defence but then Mr. Scumbag's family goes to court and sues you for all you're worth.

The law has not changed the standard one must meet when using deadly force in one's defense.

As a concealed weapons permit holder in Florida it's about time they put the law on the side of the good people who receive training and an FBI background check to receive their CWPs. *Don't take anything literally from the Brady campaign or the newspapers - they are just there to incite fear and sell papers.

Re: Only in Florida

I do like that it basically means you can shoot someone in yer house. I hate that someone can break into your home, and if you kill them, you can be tried for murder because you don't know whether or not he was gonna try to kill you. Its dumb.
