Maine Speeding Laws/Process...any info?

Hi,

Just wondering if anyone from Maine or familiar with Maine can offer some insight into the speeding ticket appeal process, or anything regarding the tickets (information required, "unwritten" laws, etc. Thanks in advance!

but most laws with tickets are simple, do a lil search on line and you will find tons of site about it.

Where in Northeastern Mass. are you? I went to college up there and am familiar with the area...

As for the speeding ticket, if you give us more info. I'm sure we can help you out. Most states are pretty much the same when appealing.

I live in the Lowell area...lived here my whole life.

Sorry if this is in the wrong section, but its technically a section to post about anything, so...

I am aware that the actual laws are posted online...found those.* However, I was looking for information more on the specific appeal process.* For instance, I know in MA that you go before the magistrate in almost a "pre-trial" hearing before the opportunity to go before a judge.* Sure most states are similar, but even the small differences could be important.

The specs are just a speeding ticket on an interstate highway.* About 15 over the "posted" limit (not sure if it was clearly posted or not).* However, the officer failed to circle what specific law it was in violation of (he did check speeding, but didn't circle which specific title/law was broken).

Just wanted to get some feedback as to the process, little "uknowns," and stuff like that, just to cover my bases.

Was it a State Trooper? I'd call whatever phone number you can find on the ticket...

not sure if judges still care about that kinda stuff. I know where I am, technicalities like that won't do anything. I had a friend try to fight a ticket cuz the police officer put that the owner of the vehicle was someone else, didn't matter the ticket was still issued to the driver at the time. Anyhow good luck with that.

yeah thats what i was thinking, it depends on the judge... ifyou try to fight it because of the mistakes the judge may not like it and stick you with a full fine..... but since you where speeding! you can alwasy be honset and say you are sorry and the judge can lower yuor ticket and pay less money..

it all depends on the judge, some of them dont like it when people try to get out of tickets with dumb stuff...... in the end he can still say you where still speeding.

It was a trooper, and what good would calling do?

That doesn't sound like a technicality...just sounds like your friend got pulled over driving someone else's car.

However, if the ticket is wrong in any way, or filled out improperly, it can't be submitted as evidence of the infraction. *As it is the only record of evidence that the law was broken, if the ticket is wrong and can't be counted on as valid evidence, it turns to a hersay argument, which the judge should dismiss. *You could simply say, "If the officer failed to properly identify that, how is it a sure thing that the remainder of the information is correct?"

no what I was saying was the cop put the previous owner of the vehicle down as the current owner - meaning there was an error on the ticket but the judge just dismissed the error as it did not affect the fact that he was speeding.

I see. Even in that case though, the information was not a misrecognition though, as the officer probably got the info from his computer and couldn't be found at fault. However, circumstances are different in this situation, because of a few factors, including (but not limited to) the aforementioned error on the officers part to mark the specific title of the violation. How am I supposed to know which code I broke if its not marked?

Obviously, that won't be the only defense. But, it being a first offense, and being out of state and not being familiar with the surroundings, one could make a plea for a warning, at least.
