friends roomated screwed her over..

need help because i don't know much about this... friend was about to move into an apt with her friend.. both signed the lease so their both liable for their payment.. found out 4 days before shes suppose to move in that her friend is bailing on her and can't move.. what can she do in that situation? Is she screwed or is it her friends fault and she'll be fine living by herself paying her part of the rent..shes just worried because she thinks thats shes going to get screwed as well and have to move back home.. any help would be appreciated

make the roommate that bailed out pay for rent until a replacement roommate is found.

ya .. good luck. That's the thing, you should always sign another agreement that states if for any reason if they change their mind they are still liable for payment. Just because they both sign doesn't mean if one bails, the other doesn't have to worry about their half. That's why roomates are trouble. We had to have our roomate sign an agreement after she said she couldn't make the entire rent one month. We decided to do a different split but hold her to that obligation. I'm not sure what to tell you in this situation. If they haven't moved in yet see what the apartment complex will do. If at all possible, maybe they can move her into a smaller apartment without breaking the lease. Good luck

have your friend consult an attorney. $50-$100 for an hour of some lawyers time is peanuts compared to being responsible for a years worth of rent, or whatever the penalties may be if she has to break the lease.

Like everyone's saying, unless you have an agreement between the two of you regarding payments, she's up a creek. The landlord or apartmant management company does not care WHO gives them the money. They only care that SOMEONE gives them the money. Usually if rent isn't payed, the penalty is an eviction and negative credit scoring. I'm sure she doesn't want negative credit scoring.

Maybe yer friend should tell her friend that if the rent isn't payed, since they both signed the lease, BOTH of their credit scores will be adversely effected. Maybe that'll get her going, maybe not. She could always appeal to her as a friend and be like "hey, yer screwin me over, ya bitch".

If they can't work it out, she should consult an attorney, as murph suggests, but most attorneys, unless they're total scumbags, will tell you if there's anything they can do before they take yer money (i.e. free consultation)

She liable for payments. Lease Agreement is a contract she signed saying shell be a partner in the lease, you still have to pay until you find a subleaser if you just leave or the landlord can sue you for the money. Make her pay essentially.
