Five orphaned siblings who moved into a new dream home on the hit ABC television show "Extreme Makeover: Home Edition" are suing the network, the company that built the house and the couple who took them in after their parents died.

The children range in age from 15 to 22. They claim that after "Extreme Makeover" built a new nine-bedroom mansion for them to live in with Phil and Loki Leomiti, the Leomitis engaged in "an orchestrated campaign" to drive them away by insulting them and treating them poorly.

The children ultimately moved out of the Leomitis' home in Santa Fe Springs, a small city southeast of Los Angeles, and are living separately with friends, said Charles Higgins II, the eldest sibling.

Their complaint, which was filed Wednesday, alleges fraud and breach of contract. It seeks unspecified compensatory and punitive damages.

"What we're really seeing is the collision between reality TV and the perception reality TV seeks to create in the minds of the general public," said their lawyer, Patrick Mesisca.

ABC said in a statement that "It is important to note that the episode was about the rebuilding of the Leomiti family's existing home to accommodate the inclusion of the five Higgins siblings, whom the Leomitis had invited into their lives following the death of their parents."

People who answered the phone at the Leomitis' home initially said the couple had no comment and later referred questions to ABC and to Endemol USA, the television show's production company. Endemol publicist Melissa Armstrong said the company had not yet reviewed the claim.

The parents of the Higgins children died 10 weeks apart in the spring of 2004 the mother of breast cancer and the father of heart failure. The Leomitis, who knew the children from church, opened their home to them in July 2004, according to the lawsuit.

Producers of "Extreme Makeover" learned of the children's plight from a television newscast.

Workers demolished the Leomitis' house in February and then built the new one. "Extreme Makeover" producers arranged for the siblings to receive cars, groceries, computers, stereos and other gifts.

The builder, Pardee Homes, paid off the mortgage on the new house but the Leomitis retained the title, according to the lawsuit. Around the time the episode first aired in late March, the siblings moved out.

Mesisca, the attorney, acknowledged Wednesday that the siblings were never promised a house in writing. But the network's statements and actions could legally be considered a promise, he said.

"We were promised a home," said Charles Higgins II. "They broke that promise."
God I hate stupid people.

I mean I feel for the kids if what they say is true but comeon, suing the network and show for it? They gave you cars and other shit that you they still have and ages 15-22, means they are all able to work.

sure maybe the cars were put in the parents names but hey then sure THEM for it.

Their lawsuit should be with the gaurdians not the show.

Umm.. k, whatever. It's television, get over it. I work for a radio station, we put on a happy face when we answer the "request line" - but anyone with half a brain knows that either the song was already in queue, or we're never going to play it (some exceptions to this, but not in most T40).

Funny... Didn't your lawyer just say you were suing over perceptions of what reality TV produces? I'm confused - which is it? You are suing because you assumed "a home" meant that you'd get the deed?

From what I read, these two kind folks from church offered to bring them in - and then a TV show and Pardee homes offered to "expand" the original home.

I'm not sure I see the validity of this claim yet - but then again, who knows what was verbally agreed to (and I don't see the networks actions, as it's mentioned above, being a home in their name).

What would be nice is if this does away with reality tv and brings back more comedies and dramas. I miss Cheers.

What ever happened to Jerry Springer being "reality" tv.... ?

Oh, and no, it shouldn't be with anyone - but the guardians are not at fault. They are under the assumtion that their contract with the TV show was giving them a house - not the guardians.

The real problem here is that it's Disney - and Disney enjoys disfunctional families. Don't believe me? Think of all the Disney cartoons - Little Mermaid, Lion King, Snow White, Bambi.... Think about it - do they have happy normal families? No - one relative is dead, perhaps by a family member, then you are forced to live with dwarfs and clean and do strip teases for them. Disney is sick. Even Aladdin -- where was the mom??

The guardians should be forced to sell the home and split the profits with the kids. If they never took the kids in they would never have that home built and paid for.

The kids are barking up the wrong tree.

Or the wrong tree is barking.

It sounds more to me that the guardians or the kids breached the networks contract.

Then again, seems like most of them are older than 18, so they are free to live on the streets if they want.

just shows how more christians are being persecuted and test of faith. the sins of greed and money are overwhelming to these people. im sure before this, there were ups and downs just like all people.

Listen, we have no clue what the hell happened here, so making comments about the kids being fucked up or the people that took them in being fucked up is just silly. How do you know that the guardians didn't take these kids in get the house then all of a sudden just start berating them and treating the kids like shit. Verbal and mental abuse is just as bad as physical. The kids could have been punks as well. I can't say cause I don't know and all of you have no clue either so just keep the comments to yourself. Damn worse then the talking heads on 24 hour news shows.
