Should counter-sue for her stupidity.
Reminds me of the hot coffee - McDonalds thing few years back.
She shouldnt get a dime as she neglected the rating on the front cover of the game.
Now there's a whole thing about Rockstar getting sued over hidden content in the game that can be unlocked with game modifiers available on the internet, why arent they sueing the people making modifiers for the game? BECAUSE THERE IS NO MONEY THERE!!!
It's easier to sue a relatively profitable organization and get some money. I feel sorry for rockstar and outraged and angry at the woman.
If I were the judge, i'd throw the case out, and make her pay for ALL the court and legal fees for both sides.
to be fair, while the McDonalds coffee case may seem frivolous, it was actually a pretty good one. Yes, she was an idiot for putting it between her legs but are you honestly saying that coffee should be served to a customer that is hot enough to provide immediate 3rd degree burns? *We're talking about burns so severe they require emergency room care, multiple surgeries and skin grafts. *
as far as the GTA stuff goes, it's pretty stupid. *But I have to admit that I see her point. *There was, in fact, data on the disc that was not disclosed to the public. *Data that, if a customer knew about it, may have prevented them from buying it in the first place. *I'll talk for days about how I think the double standard exists for sex vs violence, and how these people are truly idiots, but I'm anxious to see how this works out. *does installing a mod violate the EULA? Does violating an EULA release the publisher from liability?
I was thinking that a similar situation would be installing an aftermarket exhaust on your car, that made it non-compliant with emissions laws. *Is Mazda to blame because they made a car that would be non-compliant if you installed an aftermarket part? Are you to blame for installing it, or is the exhaust maker at fault because they knew what would happen? *
What if Mazda designed their car to be used with this specific non-compliant exhaust, but then decided to go with something compliant but didn't change the design. *Are they at fault for not disclosing that?
Again, I see the lady's point even though I don't agree with her. *I think she's an idiot for buying the game for her grandson, but maybe she truly does think that copkilling is ok but sex isn't, and would not have purchased it knowing this. (fat chance, but I'll give her the benefit of the doubt.)
