I'm shocked she'd do this during the bush administration. I expected Renquist.

Rehnquist, who is battling thyroid cancer and had been widely expected to resign, will step down this summer, giving Mr. Bush another seat to fill.

Mr. Bush scheduled a statement for later this morning in the White House Rose Garden.

In a letter sent this morning to the White House, Justice O'Connor said she would step down as soon as her successor was named.

“It has been a great privilege, indeed, to have served as a member of the court for 24 terms. I will leave it with enormous respect for the integrity of the court and its role under our constitutional structure,” she said in the three-sentence letter.

Her decision even took allies of the White House by surprise.

“An O'Connor resignation was not one we took seriously,” said C. Boyden Gray, a former White House counsel who founded the Committee for Justice, one of the key advocacy groups set to back whoever the president nominates. Mr. Gray received a text message during an interview with The New York Times at his Georgetown home shortly after 9:30 this morning informing him of Justice O'Connor's resignation.

“It makes me nervous,” he said. “I'm not sure we are as prepared for an O'Connor vacancy.”

Well, she was 75. I'm not sure why you're "shocked she'd do this during the bush administration"- she was appointed by a Republican President.

A very different republican president. Bush is anti-abortion, among many other things that she believes in.

It's pretty surprising since she is in very good health. Most Supreme Court retire when they are quite ill. The rumor that has been on the news is because she wants to help with her husband who is quite sick. Even so, its very surprising that this is during the Bush administration, she was the 6th and solid supporter of Roe v Wade. Though she was nominated by Ronald Reagan (a republican) she was sided with many liberal issues, as Regan did.

Now that Bush has to elect a Justice of his choice, this could prove to be very swaying in upcoming Supreme Court issues. He will certainly pick a justice that is quite conservative, so we shall see... but it really is pretty important news that was released today.

I am sad to see such a profound person leave the bench. She's the last conservative I'd like to see leave during the W administration. I do understand her desire to spend some some final time with her husband, though. While I didn't always agree with her decisions, I knew I could usually trust her motives. I'm scared to think that this could only be the beginning of the Bush nominees.....
