10. FMVstore

10.1 Incorporation of Terms

This document incorporates by reference all terms defined in Section 2.

10.2 Application

This document is applicable to the FMVstore. By using the FMVstore you agree to these terms of use and all other applicable material.

TrapZero SO & FMVp reserve the right to change these FMVstore Rules & Regulations at any time and without notice.

For Branded Items: Section 10.1, 10.2, 10.3.x, 10.6
For STR Items: Section 10.1, 10.2, 10.4.x, 10.5.1.x, 10.6
For STO Items: Section 10.1, 10.2, 10.4.x, 10.5.2.x, 10.6

10.3 Branded Items

Items branded with the logo or text relating to an FMVp forum are subject to the following rules. These items model numbers (ID numbers) are nine alphanumerics long and start with an "FMV", "FFC", "M3F", "MSP" or another abbreviation for a forum.

10.3.1 Sales
  • All orders should be made via the FMVstore website or by special order approved only by MZ6ZoomZoom. Special orders may be approved or denied for any reason or no reason at all.

  • Payment may be made only via PayPal, whether with an account or by using PayPal without an account, unless by special order approved only by MZ6ZoomZoom

  • All sales are final. No refunds will be issued.

10.3.2 Items
  • Items should conform in all material respects to specifications listed on the FMVstore

  • Minor variations may exist

  • Items are offered "as-is" and "with all faults."

  • Installation of an item is the responsibility of the user/purchaser, and any damage done to the item during installation, or at any point after receipt of the item, shall not be the responsibility of FMVperformance Automotive Communities, its agents or assigns.

10.3.3 Shipping
  • At this time, all shipping is done via USPS First Class. Alternative shipping methods are available ONLY by special order, and may be denied for any reason or no reason at all.

  • Standard shipping time is 2-4 weeks in addition to any production time, if relevant.

  • Shipping time is not guaranteed.

  • Shipping updates are provided only by e-mails sent through the FMVstore.

  • PM's and e-mails will be answered ONLY if it has been over 2 weeks since the last update. E-mails may be answered through store updates.

  • No refunds will be issued for shipments taking less than 6 weeks, in addition to any production time, if relevant.

10.4 Non-Branded ("STR" and "STO&quot Items

The FMVstore now sells a variety of items such as (without limitation) radar detectors, iPod accessories, cameras and other electronics. These items can be identified by their 12-alphanumeric model number (ID number) which starts with "STR" or "STO". This section applies only to these items. In addition, there are differences in the return and damages policies regarding STR and STO items. Please ensure that you have read the correct policies regarding your desired item.

Our company offers only the finest products available and we make every effort to meet your high standards for quality products, accurate descriptions, reliable shipping and exceptional customer service. If you should experience a problem, question or concern, please contact us immediately.

10.4.1 Sales

  • All sales are subject to the appropriate return policy for STR or STO items located in this document.

  • Most "STR" items are available only in the 48 contiguous states. Items will be marked as such if they are available elsewhere.

  • Most "STO" items are available world-wide.

10.4.2 Items

  • Items are offered with manufacturers warranties only. Return for certain items may be available as per the policy located in the appropriate sections for STR or STO items in this document.

  • Installation and use of an item is the responsibility of the user/purchaser, and any damage done to the item during installation, or at any point after receipt of the item, shall not be the responsibility of FMVperformance Automotive Communities, its agents or assigns.

  • User is responsible for purchase and use of items in compliance with their local laws.

  • FMVstore and TrapZero SO are not responsible for injuries due to the use of these items.

10.4.3 Shipping
  • Items may be shipped using a variety of methods, and from a variety of sources and locations.

  • Standard shipping time is 1-3 days, plus transit and delivery time, in addition to any production time, if relevant.

  • Shipping time is not guaranteed.

  • Shipping updates are provided only by e-mails sent through the FMVstore.

  • No refunds will be issued for shipments taking longer than expected.

  • For most items, there is a shipping fee of $9.99, $15.99 or $19.99. Some items may incur fees above or below these amounts.


10.5 Return Policies for STR and STO Items

Please note that STR and STO items return policies vary. Ensure that you have read the correct policies.

10.5.1 Return Policy: STR Items Only

This policy relates to non-forum-branded items which have an FMVstore model number (ID #) which is 12 alpha-numerics long and begins with "STR." Please ensure you are reading the correct policy.

10.5.1.1 Return Policy: STR Items Only

					If for any reason you are not satisfied with a product, please contact us before sending the item back. Since we deal with several sources, we will need to send you proper instructions on how and where to return the item(s). 
					


					We guarantee that all products you buy are free of defects or you may return it immediately for a new replacement. If your item was damaged during shipment, please contact us and we will send you proper instructions on how to file a claim. 
					


					If you are not satisfied with your item, you may return it to us within a period of 30 days.  [b]For orders shipped to the UK, the period allowed for returning an item is 3 days.[/b]
					Shipping cost is non-refundable for undelivered, unclaimed, returned and refused packages, unless we made an error.
When returning an item, please make sure to use all the original packaging wherein the shipment has come to you, with all accessories and owners manual. Do not write, stick or glue anything on the product package that can damage the package. You can include a separate letter to explain your returning reason with a reference to the RMA number.

There will be a 50% restocking fee on non-damaged items that are returned in damaged package.

If a shipment is refused at the door or cannot be delivered for whatever reason we will deduct these fees from the refund which will be added to the normal restocking fee.

There is also a 20% restocking fee on non-damaged items that are returned in exception for hand made jewelry items which cannot be returned or refunded from the time the fabrication begins.

					RMA numbers can be requested through our online ticketing system.  Simply click on the CONTACT US link to create a ticket and please make sure to include your order number and a clear description of why you need to return the item.
					
Some items are non-returnable (except due to damage). This includes all cell phones, cameras and camera accessories. Please be aware of this.

					[b]10.5.1.2 International Shipments[/b]
					


					Orders that are shipped outside the supplier country might incur custom and sales taxes.  It is the buyer's responsibility to pay for these additional fees at the time of delivery.  If a shipment is refused we will deduct these fees from the refund which will be added to the normal restocking fee.
					


					[b]10.5.1.3 Typographical Errors[/b]
					


					In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers or from staff error, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge. In order to capture as much detail in our images for your benefit, actual jewelry size may be different than the size they appear in the site due to extreme close ups of the images. 
					

				
	                [b]10.5.1.4 ADDITIONAL TERMS WHICH APPLIES TO CELL PHONES[/b]
    	            

				
					We will not accept returns for non-damaged Cell Phones and Cell Phone Accessories. If your item is defective, please contact the manufacturer. For damaged cell phones, we must receive a request for a RMA within 7 days from the date of delivery otherwise the RMA will be declined.
					


					
[b]Cell Phones Information: GSM vs CDMA and Frequency concerns.   [/b]


This supplier tries to provide the best quality of support, and with the large variety of cellular phones offered, there are some factors you should be aware of. A large part of their cellular inventory consists of GSM phones.


Some GSM (Global System for Mobile Communications) providers include Cingular, Tmobile, AT&T, etc. A GSM network differs from a CDMA (Code Division Multiple Access) network in several ways, the easiest to distinguish by being that a GSM phone requires a SIM card (which is not included). SIM cards can be obtained from your provider. 


When purchasing a GSM phone you should take into consideration which bandwidth frequency is available in your area. Please contact your service provider for assistance.


The frequency coverage depends on the area and your service provider.


GSM cellular phones only run on 4 possible frequencies, 850/900/1800/1900.


Quad Band phones can run on all 4 frequencies, Tri Band phones will only work on 3 out of the 4 frequencies, and Dual Band phones will only work on 2 out of the 4 frequencies.


850/1900 are US frequencies, and 900/1800 are international frequencies.


The majority of the Tri Band phones are 900/1800/1900 which means they work internationally as well as on a US 1900 frequency (850 frequency will not work). Please check with your provider for details on the frequency in your area prior to placing your order. 


Phones returned due to frequency issues are subject to approval and a 20% restocking fee.


All phones intended for use with carriers other than GSM networks are marked accordingly.


As the majority of phones are international models, and are not assigned to one specific carrier, unless marked otherwise, the GSM phones can be used on any GSM network: Cingular, Tmobile, AT&T, etc. However for best service from your cellular phone, the above frequency regulations must be observed.
*Cell phones which are marked as unlocked ( being international phones ) are not capable of working on the internet. They are not enabled to browse the internet and will not be able to access it.

This supplier also provides you with certain CDMA and IDEN phone models which work with the provider specified ion the item description.

All phones intended for use with CDMA and IDEN networks are specifically marked.

PLEASE NOTE: All cellular phones are sold as is and do not include manufacturer warranties. Please refer to the return policy for further information.

Also, please note that we will not accept returns for non-damaged Cell Phones and Cell Phone Accessories. For damaged cell phones, we must receive a request for a RMA within 7 days from the date of delivery otherwise the RMA will be declined.

Finally, please note that all Nintendo and PS3 consoles are not eligible for returns. All sales on these items are final.



10.5.2 Policies: STO Items Only

This policy relates to non-forum-branded items which have an FMVstore model number (ID #) which is 12 alpha-numerics long and begins with "STO." Please ensure you are reading the correct policy.

10.5.2.1 Limited Warranty Policy: STO Items Only

FMVstore Limited Warranty Coverage

All our products carry a five day limited warranty. All branded electronics that FMVstore sells are original and brand new. Manufacture's warranty is normally 12 months (please check this with your local service centre). The manufacture may refuse to honour the 12 months warranty if the product is imported, this is at the manufacturers discretion.

The limited warranty covers the following faults described below.

DOA (Dead on Arrival) implies that the product either cannot be turned on or be ready in use after taking out of the box. Buyer must report this situation to FMVstore within 24 hours of receipt. If the item is not tested or examined by the buyer within the first 24 hours after the goods are received, the DOA returned policy would not be valid.

No further exception will be considered about the time issue. The 24 hours period starts from the time recorded as "delivered" in the courier service's tracking system.

FMVstore will replace or repair a DOA item, In the event that a replacement or repair cannot be made due to product unavailability or any other technical reason, FMVstore will refund the buyer in full including the original shipping charges. A repair order may take up to 14 business days starting from the day when FMVstore received the defective unit. FMVstore has the right to make the final decision on whether a replacement or a repair process should be issued under any circumstances or situation.

Neither network dependent features nor firmware related issues will be covered by our limited warranty repair coverage, regardless if the problem is permanent or not. Please refer to our product compatibility section regarding on the description of network dependent features. FMVstore has the right to determine whether the issue pointed out by the buyer is a network dependent feature or not. FMVstorehas the right to make the final decision on whether a repair process should be issued under any circumstances or situation.

Under any circumstances, FMVstore reserves the final rights to approve any DOA replacement or a warranty coverage repair. FMVstore also has the right to make the final decision on whether the issue pointed out by the buyer is considering a defect or not. In the event that a replacement or repair is not granted to the buyer, FMVstore will send back the product back to the buyer; In this case it is the duty of the buyer to cover shipping costs.

The repair process by FMVstore may take up to 14 business days upon item being received from the buyer.

"FMVstore" may refer to FMVstore or its assigns. Please do not send any items to us without checking first. You may be required to ship internationally.

10.5.2.2 Return Policy: STO Items Only

All returns must be approved by FMVstore a duly completed returns form must be completed by the buyer and emailed to MK Enterprise for approval, Returned items without an approval form from FMVstore will not be processed. Any shipping and handling expenses on returns without a duly completed approval form will be the responsibility of the buyer.

Upon receiving the return from the buyer, FMVstore will examine and test for the defect, If FMVstore cannot reproduce the same fault indicated by the buyer, the return will not be accepted.

All return shipments from FMVstore will be via ground shipping method or the equivalent subject to be determined by FMVstore

In the event of returning the product, buyer is fully responsible for the product's safe return to us. Item must be received within 7 days and by insured post.

The return merchandise should include the RMA number that was issued by the FMVstore order number, full name, shipping address, contact phone number, and the reason for return. All accessories and manuals must be included inside the package as it was originally received by the buyer. Return merchandise should be boxed and well packed. Any missing parts, damaged items or inappropriate information will not be accepted. FMVstore will have the right to dispose of any unidentified return aged over 14 days without notifying the buyer.

No replacement will be issued on those unidentified returns once it has been disposed of. Buyer is responsible for the returns shipping cost. The standard replacement shipping by FMVstore will be ground shipping / Air Mail or the equivalent subject to be determined FMVstore

10.5.2.3 Insured Shipping: STO Items Only

This section applies only when such shipping is offered by FMVstore. If it is not shown to be offered, please contact an FMVstore representative if you desire it.

Shipping insurance is a guarantee that the shipment will be compensated in case of lost in transit or damaged on arrival up to the declared value of the shipment only. You are not covered for any other risks including third party losses, loss of trade or re-directed packages. (You are reminded that your tracking number should not be given to your customer as they could re-direct the package.)

Shipments without shipping insurance will only be covered for up to the declared value. Shipments declared at over US$100.00 will be automatically insured to $100.00 US Dollars. Maximum.

With this shipping insurance option, we will either replace or refund to your drop ship account when lost in transit or damaged on arrival.

For each shipment with a total package value over US$100, you may purchase an additional coverage against loss or damage at US$0.64 for each additional US$100 in package value or fraction thereof.

International air shipments may also be governed by the Warsaw Convention, including its liability limitations. For each shipment with a total package value over US$100, you may purchase an additional coverage against loss or damage at US$0.64 for each additional US$100 in package value or fraction thereof.

The shipping insurance will be calculated and charged for the Total Declared Value of Package, not the item transaction value.
